In the third putative class action brought against EFX Performance, Inc., this one filed in New Jersey, alleging a national class under the New Jersey Consumer Protection Law, FBBC obtained a full dismissal of claims in favor of its client. On March 1, 2011, six weeks after the first two lawsuits were filed against EFX in California (one in state court and one in federal court), this second copycat lawsuit was filed in New Jersey. Upon receipt of the complaint, FBBC acted swiftly to team up with local counsel in New Jersey. The team’s focused and aggressive litigation caused Plaintiff’s counsel to re-think their case, ultimately dismissing it altogether.
